1. Agreement to Terms
Welcome to Imarapath (operated from Tanzania). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services at imarapath.com (collectively, the "Platform").
By creating an account or using Imarapath, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use our services.
2. Who Can Use Imarapath
To use Imarapath, you must:
- Be at least 18 years old
- Have legal capacity to enter into binding agreements
- Not be barred from using our services under applicable law
- Provide accurate registration information
- Verify your email address
3. Account Responsibilities
You are responsible for:
- Keeping your password secure and confidential
- All activities that happen under your account
- Notifying us immediately if you suspect unauthorized access
- Maintaining accurate, current information
We are not liable for losses caused by unauthorized account use due to your failure to keep credentials secure.
4. Terms for Job Seekers
You agree that:
- All resume content and personal info you provide is truthful and accurate
- You will not impersonate another person
- You hold rights to share any content you upload (resumes, cover letters)
- You understand AI will score your applications, final hiring decisions are made by humans
- Companies you apply to receive your application data and may contact you
You retain ownership of:
Your resume, cover letters, profile information, and other content you create. You grant us a license to display this content to relevant companies on the Platform.
5. Terms for Companies
You agree that:
- You are authorized to post jobs on behalf of your company
- All job postings are legitimate, lawful, and represent real opportunities
- You will not discriminate based on protected characteristics (age, gender, race, religion, disability, etc.)
- You will treat candidate data confidentially and only use it for hiring decisions
- You will not share candidate data with third parties without consent
- Job posts are subject to AI content moderation and admin review
- We reserve the right to remove jobs that violate our guidelines
You will NOT use Imarapath to:
- Collect resumes for purposes other than the specific posted role
- Sell, transfer, or share candidate data outside your hiring process
- Post fake or misleading jobs
- Charge candidates fees of any kind
- Recruit for MLM, pyramid schemes, or fraudulent opportunities
6. Prohibited Conduct
You agree NOT to:
- Post false, misleading, or fraudulent information
- Harass, threaten, or discriminate against other users
- Use the Platform to send spam or unsolicited communications
- Attempt to circumvent security measures
- Scrape, crawl, or use automated means to access the Platform
- Upload viruses or malicious code
- Use the Platform for any illegal purpose
- Impersonate any person or entity
- Share account credentials with others
Violation may result in immediate account termination and possible legal action.
7. Your Content
You retain ownership of content you upload (resumes, job posts, messages, profile info).
By posting content, you grant Imarapath a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute that content for the purpose of operating the Platform.
You represent that you have all necessary rights to grant this license and that your content doesn't infringe on anyone else's rights.
8. AI Use & Limitations
You understand and agree that:
- AI scoring is an automated assessment and may have errors
- AI moderation may incorrectly flag legitimate content
- Final hiring decisions are made by humans, not AI
- You can request human review of any AI assessment
- We continuously improve AI but make no guarantees about accuracy
9. Fees & Payments
Current pricing (subject to change):
- Imarapath is currently FREE for both candidates and companies during our early phase
- We will introduce paid plans for companies in the future
- We will provide at least 30 days notice before introducing paid features
- Candidates will always be able to use core features for free
10. Account Termination
You can terminate your account anytime by:
- Emailing us at support@imarapath.com
- We'll process deletion within 30 days
We may suspend or terminate your account if:
- You violate these Terms
- Your conduct is harmful to other users or the Platform
- We're required to by law
- You haven't logged in for over 2 years
Upon termination, your data will be deleted per our Privacy Policy.
11. Disclaimers
Imarapath is provided "AS IS" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for purpose, and non-infringement.
We do not guarantee:
- That you will find a job or hire the right candidate
- That the Platform will be uninterrupted, secure, or error-free
- That AI assessments are perfectly accurate
- That third-party companies on the Platform will behave properly
12. Limitation of Liability
To the maximum extent permitted by Tanzanian law, Imarapath and its affiliates will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Platform.
Our total liability for any claim will not exceed the amount you've paid us in the past 12 months (which is currently zero, as the Platform is free).
13. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via email and on the Platform. Continued use after changes means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United Republic of Tanzania. Any disputes will be resolved in courts located in Dar es Salaam, Tanzania.
